General Terms and Conditions of Use

These General Terms and Conditions of Use ("Terms") are entered into by and between you and Pit Stop Wheels, LLC., an Arizona corporation (hereinafter referred to as "Pit Stop Wheels" or "PSW"). In consideration of your use of and access to this Internet site, Pit Stop Wheels personal one-on-one telephone ordering, and the promises and obligations herein, and intending to be legally bound, you and PSW hereby agree as follows: Your access to and use of PSW Services is subject to these Terms, which incorporate the Privacy Statement as well as any modifications to them issued by PSW and all applicable laws and regulations. If any of PSW Services set forth separate or additional terms and conditions of use, privacy statement, or other policy ("Separate Terms"), then those Separate Terms as modified from time to time shall apply in connection with your use of that PSW Service. To the extent there is a direct conflict between such Separate Terms and these Terms, the Separate Terms shall govern. BY USING PSW SERVICES, YOU AGREE TO AND WILL BE DEEMED TO BE BOUND BY THESE TERMS AND OTHER APPLICABLE POLICIES. If you do not want to be bound by these Terms or policies, do not use Pit Stop Wheels' Services.

Among other things, PSW Services provide information concerning various products and services and the opportunity to obtain additional information concerning those products and services or to purchase them. These Terms and the information provided by PSW Services in no way override the terms and conditions of your purchase of any product or service except as specifically provided herein. To the extent any area within or feature offered by PSW Services contains specific terms and conditions concerning its use ("Specific Terms"), those Specific Terms are in addition to these Terms. To the extent there is a direct conflict between these Terms and the Specific Terms, the Specific Terms shall govern.

Changes in Terms

PSW shall have the right at any time to revise these Terms or to impose new terms and conditions with respect to access to or use of PSW Services. You are responsible for reviewing these Terms periodically for any modifications to these Terms that may affect your rights or obligations hereunder. ANY ACCESS OR USE OF PSW SERVICES BY YOU AFTER REVISIONS OR ADDITIONS TO THESE TERMS SHALL CONSTITUTE AND BE DEEMED TO BE YOUR AGREEMENT TO SUCH REVISIONS OR ADDITIONS. Be assured that you are only obligated to the Terms and Conditions and any Specific Terms that were in effect ON OR BEFORE the date and time of your purchase – not changed after purchase.

Compliance with Laws

You agree to comply with all applicable laws, statutes, ordinances and regulations regarding your use of PSW Services and your purchase of products and services through them. You must be at least 18 years of age to use Pit Stop Wheels' Services.

CONTENT

The text, images, photographs, graphics, logos, illustrations, descriptions, data, and other material provided by PSW on or through PSW Services, as well as the selection, assembly, and arrangement thereof, are referred to collectively as the "Content". The Content may contain errors, omissions, or typographical errors or may be out of date. PSW makes every effort to keep content accurate and up to date, however, vendor prices change therefore, PSW prices will change. Pit Stop Wheels may change, delete, or update any Content at any time and without prior notice. The Content is provided for informational purposes only and is not binding on PSW in any way except to the extent it is specifically indicated to be so.

Unless otherwise noted, all Content is protected by copyrights, trademarks, service marks, and other proprietary rights that are owned by PSW or by third parties that have licensed or given oral consent for their use to Pit Stop Wheels. You may view and use the Content only for your personal information and for shopping and ordering on or through the PSW Services, and for no other purpose, and you shall retain intact all copyright and other proprietary notices. Except as provided in the foregoing, PSW does not grant to you or any person any right to use, reproduce, copy, modify, transmit, display, publish, sell, license, create derivative works, publicly perform, or distribute by any means, method, or process whatsoever, now known or hereafter developed, any of the Content on or transmitted through PSW Services, including without limitation by transferring, downloading, or otherwise copying any Content onto any disk drive or other storage medium. Any use of the Content, unless expressly permitted in writing by a Pit Stop Wheels, LLC member or agent, is strictly prohibited.

Links to other Internet sites operated by third parties, including Pit Stop Wheels' vendors, do not constitute sponsorship, endorsement, or approval by PSW of the content, policies, or practices of such linked sites. Linked sites are not operated, controlled, or maintained by PSW, and PSW is not responsible for the availability, content, security, policies, or practices of linked sites, including without limitation privacy policies and practices. Links to other sites are provided for YOUR CONVENIENCE ONLY, and you access them at your own risk.

Prices and Orders

All prices displayed in PSW Services are quoted in U.S. dollars. PSW may restrict delivery to addresses within the United States and Canada. PSW will add shipping and handling fees and applicable sales/use tax and notify buyer by telephone, fax or e-mail, whichever buyer has chosen as a method of contact, prior to charging any fees. PSW reserves the right without prior notice to discontinue or change specifications and prices on products and services offered through PSW Services without incurring any obligation to you. PRODUCTS AND SERVICES OFFERED ON THIS SITE ARE AVAILABLE WHILE SUPPLIES LAST. Descriptions of, or references to, products or services offered by Pit Stop Wheels' Services does not imply manufacturer(s)' warranty of said product or service by Pit Stop Wheels.

The receipt by you of an order confirmation does not constitute PSW's acceptance of an order. Prior to PSW's acceptance of an order, verification of information and approval of the order will be attempted by PSW to insure correct merchandise is being ordered and insure that any monetary exchanges are absolutely valid and correspond with billing addresses. PSW reserves the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation from PSW, for any reason. PSW reserves the right to limit the order quantity on any item and to refuse service to any customer without prior notification. In the event that a product or service is listed at an incorrect price due to supplier pricing information or typographical error, PSW shall have the right to refuse or cancel orders placed for the product or service listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, PSW SHALL PROMPTLY issue a credit to your credit card account in the amount of the incorrect price. The risk of loss and title for all products purchased by you and shipped by PSW pass to you upon PSW's delivery to the carrier for shipment. The risk of loss and title for all products purchased by you and shipped directly by one of PSW's vendors pass from such vendor to you upon such vendor's delivery to the carrier for shipment.

Indemnification

You agree to defend, indemnify, and hold harmless PSW, PSW's vendors, and their affiliates and related entities and their respective directors, officers, employees, and agents from and against all claims, losses, damages, liabilities, and costs (including without limitation reasonable attorneys' fees and court costs), arising out of or relating to your breach of these Terms or your access to or use of the PSW Services. The foregoing indemnification obligation shall survive termination of these Terms and the operation of the PSW Services or any product or service provided to you arising out of or relating to your use of the PSW Services.

IMPORTANT INFORMATION BEFORE YOU ORDER:

(this should be under "Ordering information" or "How to Order" because I wrote all of this) We carry a wide, selective range of outstanding wheels. We have enjoyed giving our customers personal attention and would like to continue this service to ensure that our customers are purchasing the right bolt patterns, the right offset, the right tire size ensuring no fitment issues. We do not have prices on every item because of various reasons (extensive bolt pattern availability or one wheel offers several different options of inserts). With regard to tire packages, we find that every customer has a different preference in tire size. Some prefer low-profile while some prefer and may need more rubber because of their location. STOCK HEIGHT VEHICLES:

We guarantee proper fitment of merchandise based on your year, make and model. If merchandise does not fit, we will send you a replacement. It is the customer's responsibility to ensure that items purchased are legal and safe for their intended use.

MODIFIED VEHICLES:

We specialize in modified vehicles, however if your vehicle has been modified (i.e., lifted, lowered, etc.), it is extremely important that you make your order directly with one of our specialists at                to ensure accurate merchandise fitment. We cannot be held responsible for receiving inaccurate information, measurements or specs and buyer may be responsible for any additional shipping costs incurred to correct the situation. It is the customer's responsibility to ensure that items purchased are legal and safe for their intended use.

TIRE PRESSURE SENSOR MONITORS:

If your vehicle is equipped with sensors to alert you that your tire pressure is low, please be advised that your wheels and tires cannot be mounted and balanced before shipping. Sensors have to be transferred from the vehicle's present wheels to the new wheels before mounting to the tires. This is important information PSW needs to know or your installer may charge you additional charges for dismounting.

Cancellation by Buyer:

Orders must be cancelled the same day the order is made. Orders cancelled after that date will be charged a 25% restocking fee in addition to any and all postage and handling charges incurred.

Damaged Goods Received Upon Arrival:

All merchandise is sent with an adult signature required. Please inspect all packages for any damage at the time of delivery and before the delivery person has left. Make a note on the shipper's receipt, obtain a copy, notify the shipping company and file a damage report. We inspect all merchandise that is shipped by us. All products carry the manufacturer's warranty (one year on chrome wheels) against peeling and other defects. We will help you receive a replacement free from defects but it is the manufacturer's final decision.

RETURN POLICY:

PIT STOP WHEELS wants you to be completely satisfied with your purchase and will do everything possible to make sure this happens. PSW guarantees that your wheels and tires will fit your vehicle. All returns must have authorization from PSW. Please contact us for assistance or return authorization number. Returned merchandise MUST be unused, in original condition, and in original packaging. No returns will be accepted after 30 days. There is no refund or return on special order items. A 25% restocking fee will be charged for all returns NOT due to our error. There will be no refund on shipping charges. If purchasing wheels only, you must test fit BEFORE mounting. Mounted wheels CANNOT be returned. Manufacturers' Warranty

Many products are packaged with the manufacturer's warranty and service information detailing specific terms and conditions. Manufacturers' warranties may vary from product to product. ALL PRODUCTS AND SERVICES SOLD BY PSW ARE SUBJECT TO ANY APPLICABLE WARRANTIES AND REPRESENTATIONS OF THEIR RESPECTIVE MANUFACTURERS. ACCORDINGLY, PSW MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO ANY PRODUCT OR SERVICE SOLD. EXCEPT AS EXPRESSLY STATED HEREIN, PSW EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS AND SERVICES SOLD THROUGH THE PSW SERVICES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
